1. Booking and customer details
You must be at least 18 and authorized to arrange the event and use the delivery location. Provide accurate contact, guest-count, address, access and event information. The organizer is responsible for communicating relevant food-handling and equipment instructions to guests and other people handling the order.
A cart or inquiry is not a confirmed booking. Online bookings are confirmed only after payment is successfully verified and a confirmation is provided. A separate written quotation or event agreement applies to any custom work it specifically covers.
2. Menu, pricing and payment
Your checkout summary shows the selected food, rentals, service charges, delivery and applicable tax before payment. Online payment is processed by Stripe. Changes to items, headcount, location, timing or service may change the price and must be agreed before the changed services are provided.
Food-only catering starts at 10 guests; rentals and the Halloween package require at least 25 guests. Regular orders require at least 24 hours’ notice. Only an order consisting solely of the Game Day Special is eligible for its shorter lead-time exception, subject to a future available delivery window. Adding other items restores the standard requirement.
3. Delivery, service and site access
Delivery is subject to the service area and time window confirmed for your order. Arrange lawful access, a suitable unloading area, any venue permissions, and a safe, stable setup location. Tell us about stairs, access restrictions, electrical needs and other site conditions before the event.
Drop-off service ends when the order is handed to you or your designated adult recipient. It does not include ongoing food-temperature monitoring or guest supervision. Full-service responsibilities extend only to the food, staffing tasks and hours specifically included in your booking.
4. Cancellations, changes, refunds and rescheduling
Contact us promptly at (469) 715-3181 if you need to cancel, change or move an event. Requests, including weather-related requests, are reviewed individually based on timing, work already performed, the written booking terms and applicable law. Ask for the agreed resolution in writing.
These website terms do not create an automatic cancellation fee, automatic payment forfeiture or a blanket nonrefundable-payment rule. Available rescheduling, refund or credit arrangements will be discussed for the individual booking. Nothing here takes away a refund or other remedy required by law.
5. Food handling, allergies and leftovers
Follow the Food Safety & Event Disclaimer and any order-specific handling instructions. After food is handed over or our contracted staffed service ends, you control its transport, storage, temperature monitoring, serving, refrigeration and leftovers. Do not serve food that has exceeded safe time or temperature limits.
Discuss allergies and dietary requirements before ordering and obtain confirmation of any accommodation. Do not assume an item is allergen-free because of its name or a general menu description.
6. Rental equipment and customer use
Use rentals only for their intended purpose and according to the equipment instructions and any setup guidance we provide. Provide a responsible adult operator, supervise guests and children, and keep equipment secure. Do not alter, relocate, repair or overload equipment without approval. Report damage, malfunction or an unsafe condition promptly and stop using affected equipment.
The customer is responsible, to the extent caused by the customer’s or guests’ actions, for loss or damage beyond ordinary wear resulting from misuse, unauthorized changes, failure to follow instructions or failure to protect equipment. Any repair or replacement claim must be based on documented loss and applicable booking terms; this provision does not authorize an undisclosed automatic card charge.
7. Weather, acts of God and events outside reasonable control
Severe storms, lightning, flooding, tornadoes, wildfire, ice, unsafe heat, utility failures, road closures, government orders and other events outside reasonable control may make delivery, setup or continued operation unsafe or impossible. We may delay, suspend or stop affected work and will communicate as reasonably practical and work in good faith toward an appropriate resolution.
Weather-related changes, refunds or rescheduling are handled individually under the cancellation section and applicable law. A force majeure event is not an automatic forfeiture of your payment and does not excuse food-safety obligations or risks that reasonable care could have prevented. Canopies are not storm shelters.
8. Responsibility and limits of liability
TO THE EXTENT PERMITTED BY LAW, TAILGATES BBQ & PARTIES IS NOT RESPONSIBLE FOR ILLNESS, INJURY, SPOILAGE OR PROPERTY DAMAGE TO THE EXTENT CAUSED BY A CUSTOMER’S, GUEST’S OR THIRD PARTY’S IMPROPER TRANSPORT, STORAGE, TEMPERATURE CONTROL, SERVING, REHEATING, EQUIPMENT USE, OR FAILURE TO FOLLOW OUR SAFETY INSTRUCTIONS AFTER HANDOFF OR AFTER OUR CONTRACTED SERVICE ENDS.
To the extent permitted by law, we are not liable for indirect or consequential commercial losses, such as lost profits, arising from an event disruption. This limitation does not apply to personal injury or any loss for which limitation is prohibited by law.
Nothing in these terms releases us from responsibility for our own negligence, gross negligence, intentional misconduct, unsafe food we supply, or any other responsibility that cannot lawfully be excluded. Nonwaivable consumer rights and remedies remain in effect.
9. Applicable law, written agreements and changes
Texas law and applicable federal law govern, without removing any mandatory consumer protection that applies to your transaction. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. A specific written booking agreement controls a conflict about that booking, except that nonwaivable legal rights always remain.
We may update these pages for future orders. The version accepted for your booking, together with later changes you expressly agree to, governs that booking. Questions or concerns: call or text (469) 715-3181.
